I never understood the strategy behind challenging Obamacare in the Supreme Court – it was going to fail – and has set a very bad precedent (maybe this was the true objective?).
What should have been challenged was the exemption, ie the double standard, of Congress to their own legislation – this is a basic violation of the intent of the Constitution (*). This fight could have been won, and would have made the Congress themselves rethink the legislation. This challenge still awaits; just the threat of it from a party of standing (Judicial Watch are you listening?) would sharpen the minds of Congress – and the Supreme Court.
(*) In Federalist #57, the chief architect of the U.S. Constitution, James Madison, explained that the new nation would remain free only so long lawmakers had to live by the same laws they imposed on the public.
