The Market Votes No

More than 60% of stocks are lower, following yesterday’s trap. I realize most of you are transfixed on the elections. We’ll get to that later on. Don’t worry about that.

Did you know that VHC is scheduled to attend court this Friday for mediation with Apple? In other words the good judge wants Apple to settle and get this over and done with. Some argue Apple is fixing to appeal. But on what grounds? It’s entirely possible that Apple will be hit with an injunction, just like what happened to RIMM, many years ago versus  NTP.

The bottom line with VHC is this:

They will continue to win lawsuits against all of the electronic manufacturers because their patents are the real deal. Eventually, licensing deals will be signed and after the ink dries, the stock price will explode to the upside.

Both gold and silver are lower today, all part of the Fed trap. Give it some time, both gold and silver will do just fine.

NOTE: It appears Rhino, MAXIMUS and Raul3 are locks.  However, crazier things have happened and the polls aren’t closing until we have a clear winner or at midnight tonight. So vote away small plebs, vote away.

    I’m sure there are plenty of grounds for an appeal in a case like this, although most or all may not be winnable.
    If AAPL does appeal they will have to post a Bond (supersedeas bond) which is usually for the amount of the judgment plus interest.
    No injunction unless it was requested by one of the parties and there are all kinds of factors before one would be issued.
    These cases are fairly complex and the Judge would like it settled I am sure.
    I defended a Del. corporation once in a shareholder derivative suit (involved accounting issues)and midway through the Judge suggested we settle because he said the jury looked confused (and it was).

      VHC didn’t just win that case. They took every issue presented before the jury. I’m sure AAPL can still appeal (you can appeal pretty much everything). But they have no chance of winning because they’re guilty as shit.

        I am pretty sure he is one of us.
        CLE credits would be nice, although I am on inactive status so I don’t need them.
        Fly could get an approved CLE course at a ski resort in Switzerland. Fly could call it Antitrust issues and Tax Ramifications in financial blogging.

            ROFL, Yep Chess is one of us. There is something in this game that draws us like a bees to honey. For the Case, VHC already is filing a new case against AAPL regarding the products that they didn’t list in the first case. VHC smells blood because they got the AAPL Developers to admit on record that they didn’t research other patents when they developed the products. For a settlement conf, most cases are settled, so discussion after a verdict is nothing new, esp if motions for new trials, appeals are possible. With VHC eating AAPL’s lunch and AAPL knowing that they will probably go down a second time, it makes total sense to settle the new case in combination with a settlement in the pending matter.
