In Case You Didn’t Know, Court is in Session

VHC is suing AAPL for patent infringement, asking for more than $700 million, plus royalties going forward ($6.00+ per iPhone). Admittedly, I’ve been nervous about the trial, especially since VHC is my largest position and if they lose–the stock is likely to be hammered into sawdust.

From what I gather, the trial is going extremely well for VHC (we have spies on the ground). They tar and feathered AAPL’s expert witness, Dr. Kelly, getting him to admit he’s been paid in excess of $6.5 million for his testimonies.

If you are wondering why VHC’s technology is so important, just imagine having to login every 2 minutes, when using your AAPL products.

VHC’s lawyers actually got Dr. Kelly to admit that logging in every 5 minutes would be very burdensome, before revealing that it would require login entry every 2 minutes, effectively making him look like a paid jackass.

The stock has been sucking wind this week because longs are nervous. You can’t blame them, forced to place their financial futures into the hands of a jury is a bit much. However, what’s interested to see is short sellers holding firm into what can be a catastrophic event for them.

Nearly 40% of the shares are sold short and short sellers have unlimited downside. If VHC wins, which is likely, the share price will likely gap higher by 50%–zeroing out a whole generation of overzealous Herb Greenberg groupies.

You have to ask yourself, Mr. Short Seller, are you feeling lucky, punk?

    The doctrine is the very military protocol used to justify the NATO bombing campaign that brought down Moammar Ghadafi’s regime in Libya.
    Gareth Evans, president emeritus of the ICG, is the founder and co-author of the doctrine.
    Billionaire activist George Soros is on the ICG’s executive board. Soros’ Open Society Institute is also one of only three nongovernmental funders of the Global Centre for the Responsibility to Protect, the group that devised the doctrine.

        By the way, even though I think Romney will win and some Coal Companies, according to logic and reason, might just go higher on that win, in my opinion I would still sell immediately if I was lucky enough to make any profit (note: I’m not long coal or coal stocks rt now) as many of the coal companies look awful – not to mention the economy in general. In any case as we all know, the market does not always act ‘logically’ . I am therefore sitting things out until I see a bit more clarity.

    Fantastic post, le Fly. Great to hear that you think a VHC win means +50% increase in pps. I’ve read too much discussion that even a VHC win would spell a “sell the news” event and would be further muted because of an Apple appeal. Does the Devil know who the F these shorts are and what the fuck they’re thinking? As a VHC long, I readily admit I’m a river boat gambler holding thru trial, but what about them, who are having to borrow at OBSCENE rates to short this stock? WTF is it that they know? Do they think they will still be able to control this thing, even after a VHC win in court?

      No one speculates better than The Fly! Admittedly he wins way more than he ever loses!
      I’ve been taking a good look at my portfolio and for the last 2 years I’ve been doing nothing more than spinning my wheels and getting no traction. For every home run I have had there was an OSG in the mix eliminating any gains! I’m starting to take a different approach to what I am buying nowadays. I am trying to be less speculative and more of a long term investor. Too often I have been selling winners and holding on to losers when I should have been doing the opposite.
      A classic example is that back in 2008 I had purchased 1000 shares in APPL that I bought in the $90.00 range. After making a solid couple of thousand dollars I sold it thinking that I did pretty well for a short term investment. If only I had held on for 4 more years I would have been up over 1/2 a million fucking dollars on a $90,000 investment!
      Loser!!!
      Three stocks that I purchased lately for the long term are MSFT, DDD and GNRC.
      Of these, MSFT is the only one paying a decent dividend. MSFT is finally about to make huge gains with the launch of Surface, Windows 8 and Windows 8 phone.
      DDD hit an all time high last week. It got hit pretty hard on Friday down over 6% but the whole market was down and I’m pretty sure that there was some profit taking going on. It’s a huge high growth company with huge profits and they just guided higher. This stock is up 195% in one year! It could be the next APPL, you never know!
      GNRC is trading at a very low P/E of 7.08. They went public in Feb. 2010 and their stock is up 156% since then!
      I know that Hurricane Sandy has given this stock a real boost but earnings growth was great even before this unfortunate event.
      VHC is highly speculative but has a huge risk reward and occasionally I will still delve sparingly into stocks such as these.

        Obviously you were joking about the next AAPL. DDD is high growth but already is 2.3bil market cap 9x book that has had a monster run. One should be buying real blood in the name if one believes it will continue explosive growth. Seems likely.

        Stocks are looking good long term. 2000 and 2007 top and 2002-2003 and 2009 bottom. Stocks caught in range lately but could explode higher.
        Take like the pace Dow was on in 2000 or in mid 90s or 2007 or 2004 long term and apply it to the price at the time until the year 2020 or something.
        Stocks have a lot of lost ground to make up during this sideways action.
        I think capital will migrate from the bond markets into stocks as well.
        Bt the 45% capital gains tax increase and 2013 budget crisis could cause some short term pain.

        Evades taxes? No uses the law legally in his favor. We have something called the IRS. It’s their job. If you don’t trust their ability to review tax records, perhaps more government isn’t the answer.
        Draft dodges? First vietnam wasnt exactly a fight that many pele saw as serving their country, their was no reason to be there, nevertheless, The country was cutting troop levels by the time he became eligible for the draft, and his lottery number was not called. Previously he was engaged in mormon missionaries which may have effected his draft status/priority. The fact that his religion is as or more important than fighting an unplugs war shouldnt exactly discredit him.

        Having a Carmen bank account? It’s called recognizing the flaws in the tax code in the US and making a superior financial decision, hence why raising taxes on the rich is an inadequate economic plan. Capital can move overseas and people can move and tax payers can use the underground economy and the upper class uses the legal income streams (usually) while the lower class and middle class may turns toward mostly illegal income streams not subject to taxes (everything from tax evasion, having a babysitting job, to dealing drugs).
        If you were Mitt Romney and could avoid paying millions in taxes by paying money to charity and moving money overseas, would you? Of course, you are lying to yourself if you suggest otherwise.
        Botox? Maybe. He is a politician so you expect him to be lazy/unattentive to details and not to produce a good image and try to win votes just like Obama tries to win votes by bchanging his accent depending on who he talks to.

I doubt the 700 million will be much of an issue for them, but $6 per phone seems like it could be a serious problem over the long term. Since Aapl is one of your thesis plays, do you see a VHC win as a game changer?

      If VHC wins, the idiot corporate execs at aapl will be elated. If VHC loses, as it should for corruption, the minds and hearts behind the apple product will be happy. Money doesn’t really matter, not even to VHC. They get a cut for every iTunes purchase, but it’s really a slice of the data mine that makes them interested in recording each transaction, the fee is nominal, at most, icing, for them.

      You are right, business will be preserved. They’ll continue to serve the lower class with cheaper product prices, having saved money losing VHC; and lower demand will also positively affect prices for consumers. Additionally, with no further need, neigh, ability, due to the loss of VHC, to tap into low-value, and, at any rate, unsalable data, they’ll be a common company, selling their product, until the pool of cell-tower, service providers dries up.
