The 9th circuit court of appeals voted 3-0 in favor of globalist shills, denying Trump his executive order to ban immigration from dangerous cesspools. Interestingly, this comparison of reversal rates reveals that the Federal Circuit has the highest reversal rate at about 83.33%, and the Ninth Circuit has the second highest reversal rate at 80%. The Seventh Circuit has the lowest reversal rate at 55.26%. The median reversal rate is 68.29%. If the courts of appeals were graded on their reversal rates according to a typical first-year law school grading curve,9 their grades would be as shown at below. So the Ninth Circuit and the Federal Circuit end up at the bottom of their “class.” Do reversal rates of 80% and 83%, for the Ninth Circuit and Federal Circuit, respectively, compared to a median reversal rate of 68%, call for the label “rogue” courts?

The 9th Circuit Court upheld the verdict of the lower court. No reversal.
If you read the ruling, there are two main arguments against the executive order. First, the executive order is singling out a religious group. Frankly, the argument is very weak with poor legal support. Second, the people that had their visas revoked were not given due process. In my opinion, this is a very strong argument that portions of the executive order were in violation of the law.
The government’s lawyers did a very poor job refuting these two arguments. At the very least, they should have torn apart the religious argument. I felt they just kind of phoned it in.
Even if the 9th Circuit court wanted to reverse the lower court’s decision, they were not presented with the arguments or case law to justify a reversal.
Trump cannot play the “activist judge” card here. Sorry.

This is no longer about the travel ban, but a challenge to the judiciary branch’s power of judicial review.
The executive branch lawyers did not present strong arguments against the religious and due process arguments because the DOJ argued that the judiciary does not have the power to review executive orders.
The judiciary has the power of judicial review, including legislation and executive orders. If this power was given up, it would rewrite the constitution, fundamentally change how our government works and render the judiciary useless. The judiciary gave themselves the power of judicial review and they will not be relinquishing it. With the current construction of DOJ arguments, if the case is appealed to SCOTUS, they will go against Trump 8-0 or 7-1.
Could be split decision, then 9th Circuit ruling stands. Ginsburg should recuse herself due to known bias.
