Maybe it’s important to bear in mind, he isn’t President yet and he won’t be the person making the decision whether to prosecute or not, the AG (Sessions) will.
Knowing the establishment are deathly afraid of a Clinton prosecution and needing Sessions to get Senate approval, it wouldn’t surprise me to hear this now, only to learn later that Sessions had decided to pursue and prosecute a case against Hillary.

Hillary knows where way too many bodies are buried for both parties and that’s a serious liability. I’d love to see her behind bars but never expected Trump to follow through with it.

Trump can “not go after her” by simply refraining to immediately appoint a special prosecutor to further the case related to her State Department emails.
That’s a far cry from ordering the shutdown of all ongoing investigations into the Clinton Foundation currently underway at multiple federal agencies, especially the IRS. And the Weiner thing ain’t over, I might add, and if there is a pizza-related situation that connects WJC or Podesta, that sort of thing will trump (yeah…) all political considerations. And I believe NYPD and NY AG have a say in where that goes, as well.

It is my sincere hope that they are trying to dupe Obama. Because if they advertise their intentions to prosecute madam benghazi, he will proceed with a “pre-emptive pardon” before he leaves office. But convinced that they merely used rhetoric to win the campaign and don’t intend to lock her up, he won’t need to risk his “legacy” with an embarrassingly corrupt pardon entangling himself with Clinton crime family in an overt way (more than he already is privately).
If Hill and the gang have indeed broken the law, they should be prosecuted. All the way up to the top.
If there is one thing this country needs to see from Trump’s election is is that there are not 2 sets of laws, one for the rich and powerful and one for the rest.
A return to actual adherence to our laws rather than skirting them in any way possible (last 8 years) would do more to restore peoples faith in our government than anything else could.
Considering Trump is making calls to foreign heads of state on unsecured lines, he’s basically doing exactly what he criticized Hillary of doing.
So yeah, prosecution of Hillary’s non-crimes would probably be a bad idea…
