Morgan Stanley disgorges profit in utility scam

CHICAGO (MarketWatch) — The U.S. Department of Justice on Friday announced that Morgan Stanley will disgorge $4.8 million in profit it racked up for its part in a scheme that restrained competition in the New York City electricity market, bilking consumers into paying higher utility prices. Morgan had entered into a deal with KeySpan Corporation that executed a financial derivative for capacity in the city while simultaneously entering into an offsetting derivative with Astoria Generating, KeySpan’s largest competitor in the market. “The agreements effectively transferred to KeySpan a financial interest in Astoria’s capacity, thereby ensuring that KeySpan would withhold substantial output from the capacity market and increase prices,” the department said. “This settlement with a major financial institution will signal to the financial services community that use of derivatives for anticompetitive ends will not be tolerated,” said Sharis Pozen, acting assistant attorney general in charge of the Antitrust Division. The department had previously cut a deal with KeySpan that required it to disgorge $12 million.
Maybe they should not be making deals like that. I suspect they settled to make the problem go away. $4.8 mil is less than attorney’s fees.
