I have no position in VHC, having sold it all above $35. But this just pisses me off.
VirnetX (VHC -10.1%) is tumbling to fresh 52-week lows on strong volume, as the Street continues weighing the fallout of an adverse jury ruling in its patent suit against Cisco. Last week, the judge presiding over the suit issued a final judgment declaring 12 VirnetX patent claims invalid, and denying all pending motions.
I am not sure if the stock is getting poleaxed due to this “news” release or the specter of a likely AAPL appeal or a major fund sold out of its position. Nonetheless, the contents of this news release are patently false, viz.
VHC lost the CSCO trial, but the patents weren’t declared invalid. As a matter of fact, the opposite is true, as their patents were confirmed by the jury, just not applicable against CSCO.
AAPL still has to pay the piper.

Seeking Alpha is all about seeking eyeballs. True/false doesn’t matter much if it’s a good narrative. if it’s false just blame the provider of the commentary.

I think that was an honest mistake, as the editor acknowledged & restated the error.
SA, by nature, will always suffer from misinformation. I haven’t tracked the SA coverage of VHC too closely, but what I have read seems broadly bullish on the stock.
This error may have been an excuse for shorts to tighten the noose, but I’m long VHC again, because the 31% short interest (12 days to cover) won’t last until quarter-end window dressing.
Not to plant rumors, but is it out of the realm of possibility that AAPL submit a takeout offer, given this pullback? I think it’s a comparable situation to TIVO…

Yes, very deceptively worded. I suppose they’d argue that “claim” meant “assertions relating to the patent”. But it definitely leaves the impression that the patents themselves were invalidated when in fact they were upheld.
