A Mustache-less Market

My Clean Energy Fuels Corp. [[CLNE]] is rolling downhill now. With Proposition 10 looming, I think it makes perfect sense to be long CLNE—at least until Congress is set to vote on it. If President Obama is really intent on “greening up,” he will go with the “Pickens plan” and give incentives to our trucking fleets to switch over to natural gas. Plus, it will save many of the land based trannies lots of money on fuel. At the present, with the low prices of natty, it will cost $1.55 a gallon to fill up. Compared to the insane prices of diesel, it’s a no brainer.

Oil just can’t catch a bid here, effectively annihilating those who are unlucky enough to be short Vulcan Materials Company [[VMC]] . Also, all of the banks are starting spring higher, due to the nonsensical notion that they benefit off of cheap oil, or something. At the end of the day, the banks trade lower. Write it down.

Nonetheless, the energy sector is bouncing today, as investors realize how gay it was to sell them “fire sale style,” yesterday.

With my money, I like [[DIG]] , [[IEO]] , but love the refiners, especially Western Refining, Inc. [[WNR]] .

The short position is monstrous (29%). With all of the storms (4) in the Atlantic now, you have to be mentally ill to be short refiners.

Finally, on the long side, I like Barnes & Noble, Inc. [[BKS]] , VeraSun Energy Corporation [[VSE]] , Southern Copper Corporation (USA) [[PCU]] and Freeport-McMoRan Copper & Gold Inc. [[FCX]] , while loathing Legg Mason, Inc. [[LM]] and Pzena Investment Management, Inc. [[PZN]] . Oh, and I also like to bet against Chinese stocks, via [[FXP]] , with impunity, based upon egregious valuations.

    Of course lower oil helps financials…I’ll explain why:

    According to the great Larry Kudlow (AKA King Dollar), people will spent less money on gas, therefore will have more money for egregious stuff like paying mortgages, credit cards and etc…

    TOP PICK- LONG: VMC, LM, BUG SPRAY; SHORT: FCX, CRUDE, _________insert any refiners…

    I believe 19% of outstanding TIVO shares are short. The put action of the past week or so has been.. egregious.

    Tomorrow, there will be a potentially major decision in the TIVO-Echostar patent trial. TIVO won the case 2 years ago, and it is still going through the appeals process. The court will rule on whether or not to enforce an injunction and there is a possibility of the court increasing damages. In the best case for TIVO, the court rules that Echostar must shut off all of its DVRs, forcing Echostar to enter a licensing deal with TIVO. In this scenario, Echostar would be over a barrel and TIVO would set the price. Existing Comcast and DirectTV licensing deals are at about $1 per sub per month. An Echostar deal, signed under duress, would be in the $2-$3 range. And, this would set a price for TIVO licensing for future deals, with say Time Warner.

    The street does not recognize the potential here (the put action reflects that). If things fall into place, TIVO could be a $20 – $30 stock in the next year.

    Today, TIVO announced a renewed deal with DirectTV. The relationship with DirectTV has been strained for the past two years, and DirectTV TIVO DVRs make up a large percentage of TIVO subscribers. This deal is significant.
