Do you remember when Rep. Nunes found out some information about the unmasking of key Trump personnel during and after the elections, which tossed former National Security Advisor, Susan Rice, on the barbie?
It was believed that Rice had some vital information that could shed some light on who Obama was spying on and why. The fact that Trump was, in fact, unmasked raised questions as to the veracity of the ‘incidental’ intelligence claims. Well, if you were hoping for Susan Rice to pay for her sins, exposing Obama to potential criminal charges for spying on Trump — too bad fuckers — that’s not going to happen.
See, the information is now locked up in the Obamas library and will not be released for another 5 years. Why is this the case? No one really knows, other than the fact that it’s in there and it is impossible to get out.
Judicial Watch is going apeshit over this.
“Documents from the Obama administration have been transferred to the Barack Obama Presidential Library. You may send your request to the Obama Library,” Powers wrote. “However, you should be aware that under the Presidential Records Act, presidential records remain closed to the public for five years after an administration has left office.”
Judicial Watch’s FOIA request sought to obtain documents related to Rice’s communications with intelligence officials on a range of issues, including any efforts by the Russian government to influence the 2016 presidential election and the hacking of Democratic National Committee and Clinton campaign computer systems.
“Judicial Watch has filed six FOIA lawsuits related to the surveillance, unmasking, and illegal leaking targeting President Trump and his associates,” the watchdog group said.
Judicial Watch president Tom Fitton said he is considering other legal options to obtain the records.
“Prosecutors, Congress, and the public will want to know when the National Security Council shipped off the records about potential intelligence abuses by Susan Rice and others in the Obama White House to the memory hole of the Obama Presidential Library,” Fitton said.
“We are considering our legal options but we hope that the Special Counsel and Congress also consider their options and get these records,” he added.

That’s the thing I don’t follow. What do you mean the documents were “sent” to the library? Nobody fucking types on typewriters anymore. They are all there electronically and backed up and replicated to a DR site. Anything with a signature is immediately scanned for the same purposes. I seem to recall there are federal regulations that require this, no?
And you would have me believe NO COPY EXISTS except for something in a banker’s box that may or may not be made available five years hence, if they aren’t “lost” before then? How stupid do you think we are?
Part II of This Doesn’t Add Up. Can’t Trump simply direct his branch of government to provide him with this kind of information? I understand we may never see it publicly if it’s classified but is he not allowed to see it himself? Don’t these people fucking work for him?
Can’t he at least order the DOJ to investigate it and report back to him with their findings?
This only applies to FOIA requests, that is, requests from the general public.
As I read it, the Presidential Records Act 1978 (as applied to Ronald Reagan’s Library forward) changes ownership of records from the former President (in this case Obama) to the US Government. In earlier times the records would have been the property of the former President.
Therefore Obama/Rice’s records are the property of the US Government under the care of the National Archives and Records Administration who will be digitizing everything over the coming years. A great deal is already in electronic form, including some 300 million emails.
As I read it, this restriction does not apply to requests from intergovernmental entities. If Justice were to direct the Special Prosecutor to dig into it, that would be another matter. Records could be requisitioned, or subpoenaed, if necessary.
Also it is not clear as to the full scope of restriction. For each of the 300 million emails, there are at least 2 parties. So if communication from Rice occurs with entities other than the Executive Branch, is that fully restricted under this act? This is not clear, and one would think that if applied too widely it could make the transition of power operationally impossible – so there must be exceptions. Clearly the Executive Branch itself must be exempt.
