I think this is about the “robo signing.”
I always thought this was nonsense as I can’t see where the damages are.
It pertains to the affidavit of indebtedness that lays out the debt, the default, and that they are the holder of the note and mortgage (in my lawyer days I represented a handful of regional banks).
That doesn’t mean the mortgages were not in default and that a foreclosure could not proceed.
At the most it would be a fraud upon the Court (and contempt)if it was “robo signed” and a human did not look at the records.
Just politicians being PC and piling on.
